Czech Populist PM-Elect Refuses to Sell Business Empire During Conflict-of-Interest Dispute

Andrej Babiš, the self-proclaimed tycoon that secured victory in last month's Czech election, has refused to sell his extensive business interests, while insisting he will address a ethical dilemma that could prevent him from assuming the role of head of government.

Position on Corporate Empire

Babiš, whose political movement emerged victorious in the October election but did not secure a majority in parliament, declared in a online statement that he would not sell his Agrofert group, which operates in farming, food production, and chemicals.

“I have repeatedly stated I will never sell Agrofert. I have consistently said I will resolve the ethical issue in compliance with Czech and EU regulations,” Babiš commented. “This is not like selling a pastry in a bakery.”

President's Requirement

The head of state, Petr Pavel, stated that the elderly populist must publicly explain how he will eliminate ethical conflicts arising from his corporate dealings before assuming the role of premier.

The national charter “explicitly requires the head of state to take into account the possible emergence of a ethical issue and the possibilities for its resolution” when appointing government ministers, the presidential administration explained.

The head of state “wants it to be clear in what precise manner Andrej Babiš will fulfil his statutory duties”, the statement said, noting that Pavel was ready to designate Babiš as prime minister “without delay” once the issue was settled.

Business Operations and Regulatory Concerns

Babiš's numerous companies, primarily under the Agrofert umbrella, operate in the Czech Republic and other central European countries, benefiting from substantial funds in national and EU agricultural and other subsidies, as well as public contracts.

Under Czech law, government ministers are barred from receiving state support or agreements. The ethics organization Transparency International has indicated that to prevent a conflict of interest, Babiš must either divest, decline public contracts, or stay out of public office.

Previous Tenure and Present Plans

Babiš affirmed he would “abide by the regulations” if selected as prime minister, but declined to explain how in beforehand because the issue was “an extremely sensitive and personal matter for me, and journalists will always question me regardless”.

During his first term as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an European inquiry over potential ethical issues. He placed his assets into fiduciary arrangements, while retaining certain control over them.

A judicial body and the European Commission both ruled that this did not suffice. Babiš confirmed recently that he was once more the exclusive proprietor of Agrofert and insisted he was “implementing measures” to avoid a conflict of interest, but refused to disclose details.

Coalition Deal and International Implications

The billionaire populist has concluded a coalition agreement with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has advocated a referendum on exiting the EU, and the Motorists for Themselves, which has primarily opposed the EU’s Green Deal.

The incoming administration, if confirmed, is likely to bolster the populist movement in the region and might strain backing from Western nations for Ukraine – even though Babiš has called Ukraine’s leader, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as president has a role for foreign policy, also demanded that the government agenda include a declaration on the government’s position on the conflict in Ukraine, including a commitment to fulfilling Nato obligations.

The president has earlier said he would not approve any cabinet candidates who might doubt the Czech Republic’s international alliances, a requirement that the far-right SPD has indicated it will satisfy by nominating independent technocrats.
